This Legal Notice governs access to, browsing of and use of the Website and the Application, as well as the responsibilities arising from the use of their contents and services.

Accessing and browsing the Website, or using the Application, confers the status of user and implies full and unreserved acceptance of this Legal Notice. If the user does not agree with these conditions, the user must refrain from using the Website and/or the Application.

RALLY RATING, S.L. reserves the right to modify, update or remove, at any time and without prior notice, the content of the Website, of the Application and of this Legal Notice, in particular in order to adapt it to legislative, technical or operational developments.

The user undertakes to use the Website and the Application in accordance with applicable law, this Legal Notice, good faith, accepted standards of conduct and public order.

The user undertakes not to engage in any conduct that could damage the image, interests or rights of RALLY RATING, S.L. or of third parties, or that could prevent the normal use of the Website and the Application, including but not limited to: entering false or fraudulent information, manipulating rankings, ratings or statistics, impersonating others, using the platform for unlawful purposes, or carrying out acts that could damage, disable or overload the Website or the Application.

RALLY RATING, S.L. may bring any legal action available to it against users who breach this Legal Notice.

Website content — intellectual and industrial property rights

The intellectual property rights in the Website and the Application of RALLY RATING, S.L., including their source code, design, navigation structure and the various elements contained in them, belong to RALLY RATING, S.L., which holds exclusive title to the rights of exploitation thereof in any form, in particular by way of reproduction, distribution, public communication and transformation.

Likewise, all trade names, trade marks and distinctive signs of any kind contained in the Website are protected, and their reproduction, use or insertion without due authorisation from RALLY RATING, S.L. is prohibited.

The user acknowledges that the unauthorised reproduction, distribution, commercial exploitation or transformation of the elements indicated may constitute an infringement of the intellectual and/or industrial property rights of RALLY RATING, S.L. or of the holders of those rights.

Accordingly, the reproduction, transformation, public communication, distribution, making available to the public and, in general, any other form of exploitation, by any means, of all or part of the contents of the Website, as well as of its design and the manner in which its contents are presented, is prohibited without the corresponding authorisation of the rights holder, unless legally permitted or consistent with the nature of the content itself.

The Website and the Application contain both proprietary images and images belonging to third parties. With respect to third party images, RALLY RATING, S.L. will at all times respect the intellectual property rights held by their authors, in accordance with applicable legislation (Royal Legislative Decree 1/1996 of 12 April, approving the consolidated text of the Intellectual Property Act).

Access to the Website and the Application does not in any case entail the acquisition by users of any property rights over the contents appearing therein.

The user may not use the contents offered on the Website and the Application for purposes other than those set out in this Legal Notice and, where applicable, in the particular terms governing the use of specific functionalities.

Liability

RALLY RATING, S.L. implements reasonably appropriate security measures to ensure that browsing the Website and the Application takes place under the best conditions. However, RALLY RATING, S.L. cannot guarantee the absence of interference, omissions, interruptions, computer viruses, faults or disconnections caused by reasons beyond its control.

Likewise, RALLY RATING, S.L. makes its best efforts to keep the contents of the Website and the Application up to date. However, it does not guarantee their accuracy, relevance or currency. The rankings and statistics generated by the Website and the Application are purely informative and recreational in nature, unless expressly stated otherwise.

RALLY RATING, S.L. may interrupt access to the Website and the Application, without prior notice, where technical, maintenance or other reasons so justify.

The Website and the Application may include links allowing the user to access sites owned or operated by third parties. The owners of those sites are responsible for the content hosted on them.

The existence of links on third party websites allowing access to this Website and the Application does not in any case imply the existence of commercial relationships with the owner of the website where the hyperlink is placed, nor acceptance by RALLY RATING, S.L. of its contents or services.

RALLY RATING, S.L. disclaims all responsibility for information found outside the Website and the Application.

Governing law

This Legal Notice is governed by Spanish law. Accordingly, in the event of a dispute or a conflict of interpretation, the applicable law shall be Spanish law.
